Database Development & Analytics

Our Database Development & Analytics services increase case efficiency by creating flexible models to accommodate changes in methodologies and add-on analyses.  In our experience, processing time is also reduced for firms that traditionally used paralegals or staff attorneys to process data internally.

We are typically retained by counsel as a consultant to assist in data extraction, examination, and application of calculations specific to the matter at hand.

For example:

  • Wage & Hour Matters - We construct daily employee timelines from a variety of data sources combining time entry data (e.g., Kronos data), GPS data, mobile phone data, and building access data to calculate on-duty hours, break periods, and on-duty mileage through the identification of first/last login/access, duration and location of customer service visits, and analysis of other specified parameters.

  • Billing Disputes (i.e., medical billing or contract disputes) - We identify specific instances of alleged over-billing considering contracted terms, or in the case of medical billing disputes, restrictions on the timing and frequency of medical services and/or provision of medication.

  • Class and Collective Actions - We analyze data for similarities between claimants, or lack thereof, to identify/verify potential class members or subclasses, if any.

Our experience in data collection and storage allows us to effectively communicate directly with the client’s information technology professionals to understand how data is stored and what data is available for extraction.

This experience, combined with our understanding of the litigation process and specific issues raised in the case, also increases case efficiency by decreasing the likelihood of additional extractions.  Our process is built to maintain the integrity of original source data and accommodate additional extractions necessary to incorporate current data or source data received at a later date or from third-parties.

When testimony is necessary, we can easily “break down” the methodology and logic in “plain language” rather than “computerese.”  We may also use summary tables, charts, and scenario/sensitivity tools to communicate our results in visual form.

Our documentation process, may include a combination of computerized documentation tools and memos-to-file detailing the process.  This dual documentation process allows us to follow the logical flow of the analysis, validate our methodology, and support testimony.

  • Identification of unit vacancy periods and calculation of vacancy rates over time for a 550-unit multi-family property

  • Examination of medical billing records for alleged inappropriate billing and alleged inappropriate denial of claims

  • Examination of transaction data collected by parties in billing and royalty disputes

  • Identification of transactions to insiders and related-entities supporting allegations of misappropriation of company funds and alter-ego claims

  • Analysis of airport pedestrian traffic in an economic damages case brought by a retail establishment

  • Comparison of customer and transaction data supporting allegations of misappropriation of trade secrets and company assets
